WikiLeaks, the law, and an unlikeable leader

Exploring the prospects of a prosecution of WikiLeaks and its leader, Julian Assange, under the Espionage Act of 1917 and other laws. Thank you to the readers who suggested questions for the panelists, who were: Abbe D. Lowell, the noted defense attorney; Paul Rosenzweig, a former policy official at the Department of Homeland Security; and Prof. Stephen I. Vladeck at American University.

The traditional way to handle this sort of thing is to write a story, a summary, but there are so many issues in play that I thought this was one where it's best to have you hear directly from specialists in the field. We have three distinguished participants, and there's a great deal of subtlety in their answers. Selecting a couple of quotes, or a tally of their "votes" on an issue, wouldn't depict that complexity.

The discussion roamed from WikiLeaks itself to the First Amendment implications of such a case, to the weaknesses of a prosecution and a defense, to the changes needed in the Espionage Act and other laws.
It's not the most important legal point, but it's notable that the three panelists all offered similar answers to the question, what is a weakness for the defense. The answer: the defendant. His statements and demeanor will hurt him with a judge and jury.

Excess crude account reached N450billion in November

The balance in the Excess Crude Oil Account surged to about N450billion at the end of last month, the accountant general of the federation, Ibrahim Dankwambo, said at the end of the monthly Federation Accounts Allocation Committee meeting in Abuja at the weekend. He said the balance of revenue in the dollar-denominated component of the ECA was about $1.9billion, while about N50billion was transferred into the domestic ECA. This excludes the $1billion already deposited by the federal government as seed money for the take-off of the newly created Sovereign Wealth Fund (SWF).

Mr. Dankwambo attributed the surge in the revenue in the ECA to increased oil production capacity under the various Production Sharing Contracts (PSCs) in recent times as a result of the declining tension in the Niger Delta as a consequence of the impact of the federal government amnesty initiative in the region, improved oil prices at the international oil market above the $60 per barrel benchmark in the 2010 budget as well as a rise in the modified carry agreement receipts by the oil companies.

“The production capacity of the multinational oil operators improved tremendously in recent times as a result of the improved operational environment as a direct consequence of the Federal Government Amnesty Programme for Niger Delta militant groups as well as increase in crude oil prices at the international market. Revenue, generally, was good, that was why there was a transfer to excess crude account (dollar), which has a balance of $1.9billion, (domestic) N50billion) and Sovereign Wealth Fund of $1billion, bringing it to close to $3billion in revenue savings. Our hope is that this level will be sustained,” he said.

More money to share
The AGF said gross revenue available for distribution among the three tiers of government for the month of November was N557.839billion, made up of N407.554billion as statutory revenue, including Value Added tax (VAT). The total figure is higher than N451.074billion from the previous month by N106.766billion. The distributable statutory revenue for the month was N364.639billion, an increase of N564million, or 0.15 percent compared to the October figure. There was no augmentation revenue for the month, neither was there an exchange gain,

considering that the prevailing exchange rate of N147 per dollar was lower than the N150 per dollar set as the benchmark. A total of about N143.043billion was transferred to the ECA, as well as for Petroleum Profit Tax (PPT) and Royalty.

Politicians killed Nigerian banks -Sanusi Calls for their arrest

 AS the controversy surrounding the statement made by the governor of Central Bank of Nigeria (CBN), Mallam Sanusi Lamido Sanusi, about the budget of the National Assembly rages on, the CBN governor has declared that politicians in the country, particularly those who participated in the second and the botched third republics, should be held responsible for killing most of the dead banks in the country.

The CBN governor, who delivered a public lecture entitled “Global Financial Meltdown and the Reforms in the Nigerian Banking sector” at the Abubakar Tafawa Balewa University, Bauchi, said that, “most of the people who killed Nigerian banks are still very much around us, they borrowed money and refused to repay them and when the banks died, they turned around and reinvested the money into their businesses with some of them becoming governors, senators, members of the National Assembly.”

Mallam Sanusi, who said that he did not believe in the categorisation of the banks as ‘failed banks’, explained that, “the banks did not fail but were killed and we must do everything possible to find the killers of the banks just like would be done to find the killers of anybody killed by some people.”
On the banking reform he introduced in the last 17 months, he stated that the reforms had brought stability to the banking sector and the Nigerian economy, adding that due to the measures put in place, no single bank in Nigeria had collapsed ever since the full implementation of the reforms.

He added that no depositor had lost money as a result of the banking sector crisis because, according to him, “the banking system has stabilised and the most affected banks have continued normal operation while modalities for injecting fresh capital into them, either by shareholders or through acquisition and merger arrangements, are being finalised.”

The CBN governor further said that the reforms had also succeeded in returning macro economic and financial system stability, adding that overall output in 2010 was expected to be higher than in 2009, saying, “projections by the National Bureau of Statistics (NBS) showed that the real GDP in 2010 will grow by 7.85 per cent compared to 6.66 per cent in 2009. The growth rate appears robust but there is need to ensure that it translates into job creation and poverty reduction.”

According to him, between 2009 and 2010, the volatility of the economy has moderated significantly explaining that, “headline inflation declined steadily from 15.1 per cent in end-2008 top 10.4 per cent in September, 2009, rising thereafter to 15.6 per cent in February 2010.
“Since then, it has maintained a downward trend to 13.4 per cent in October, 2010.”

However, on the challenges of the reforms, he said that the major challenge was how to sustain and translate the stability into employment opportunities, because, according to him, “the link between major growth drivers, particularly agriculture and manufacturing, has continued to be weak,” there was, therefore, the need to urgently address all binding constraints to growth, he noted.

He also said that, “inadequate or absence of basic economic and social infrastructure remains a major binding constraint on Nigeria’s economic growth and development. There is, therefore, an urgent need to fast-track the proposed reforms in some key sectors of the economy, notably power and oil and gas sectors, to attract the much-needed investment and reduce large import bills on refined petroleum. There is also need to deepen the deregulation process in the electricity process and transport sector to attract private investment.”

Chris Brown tries to put his troubled past behind him with a new romance

He may have a bad reputation, but Chris Brown tried to show is softer side as he visited a Miami beach with his latest girlfriend, Jasmine Sanders, and his new puppy.
The couple both dressed in very casual clothes, dipped their toes in the water to cool off during their stroll.

Many have said that Jasmine looks re-markedly like Chris' former girlfriend, superstar singer Rihanna.
The With You singer somewhat struggled to make a come back after being convicted of beating Rihanna in March last year, during a row while the two of them were riding together in a rental car.

She is currently happily dating LA Dodgers player Matt Kemp.

Swedish Police Probe Stockholm Blasts as Terrorism

Police in Sweden say two explosions in central Stockholm that killed one person and injured two others was a terrorist attack.

Police spokesman Anders Thornberg told a news conference Sunday the explosions are being investigated under Swedish law as an act of terror, but that authorities have not raised the security level.

Police say the first blast Saturday occurred in a car near a busy shopping street, slightly injuring two people.  Shortly afterward, a second explosion was heard on the same street.  Police later found one person dead at the scene.  Authorities believe that person was a suicide bomber.

Swedish news agency TT said Saturday that 10 minutes before the blasts, it had received an e-mail in Arabic and Swedish, warning of unspecified "action."

The news agency said the warning, also sent to the Security Police, referred to Sweden's involvement in Afghanistan and to caricatures of the Prophet Muhammad by the Swedish artist Lars Vilks.

UN deal sets pace for emissions

A LAST-MINUTE agreement at United Nations talks has increased pressure on the Gillard government to lift its ambition in tackling climate change, with the Greens saying Labor has ''no choice'' not to set a more ambitious target than a 5 per cent cut in greenhouse gas emissions.
A final overnight session ended with UN negotiators for the first time backing an agreement that formally included targets from the US, China and India.
The deal included arrangements for protecting rainforests and a planned $US100 billion ($101 billion) green climate fund to help the most vulnerable nations cope with the effects of climate change.
The Cancun agreement included steps to ensure transparency in emissions measurement and reporting - a key sticking point for China and the US at last year's disastrous conference in Copenhagen.
But while representatives from more than 190 countries agreed to seek ''deep cuts'' in emissions, the deal does not include targets big enough to meet the goal of limiting the global temperature rise since industrialisation to 2 degrees.
Researchers for the Climate Action Tracker estimated the emissions pledges would set the world on course for 3.2 degrees warming - enough, scientists say, to cause droughts, crop failure, species extinction and increased damage from floods and storms.
Despite this, climate activists welcomed the deal as a step forward that could lay the groundwork for a binding treaty in South Africa next year, or Rio de Janeiro in 2012.
The Climate Institute deputy chief executive, Erwin Jackson, said it was a more significant result than the 2007 Bali climate conference, when wealthy nations recognised they should cut emissions by 25-40 per cent by 2020.
''It has broken the back of starting to capture all the major emitters in a legally binding framework,'' he said.
The Climate Change Minister, Greg Combet, said the conference was a ''historic step forward'' but that a lot of work remained if there was to be a single treaty covering all big emitters.
The Greens deputy leader, Christine Milne, said the agreement would raise the stakes in the Australia climate debate as the multi-party climate committee sought a deal to introduce carbon price legislation next year.
She said Labor had no choice but to increase its ''inexcusably weak'' pledge to cut emissions by between 5 and 25 per cent below 2000 levels by 2020.
''The world's poorest countries made very significant concessions in these negotiations in order to keep the UN process alive,'' Senator Milne said. ''Next time around rich countries like Australia will be expected to make similarly substantial contributions.''
The Coalition climate action spokesman, Greg Hunt, said the results at Cancun were modest, and would not sway it from opposing a carbon price.
The agreement bought more time for nations to negotiate a second commitment period under the Kyoto Protocol beyond 2012, although that process remains fraught.

Meningitis kills 1,720 people in West Africa, says Onyebuchi

The Minister of Health and President of ECOWAS Assembly of Health Ministers, Prof. Onyebuchi Chukwu, has said that from January 2010 to date, meningitis had hit seven countries of West Africa, causing 1,720 deaths.
“In truth, epidemic-prone diseases have always prevailed in our environment. Cholera alone has caused in 2010, approximately 1900 deaths in 8 countries; meningitis hit 7 countries since January 2010, causing 1,720 deaths; measles a disease placed in test phase, is growing every year, reflecting not only the weakness of our health systems, but also their inability to sustain gains achieved with the mass action through international support,” he said.
Prof Chukwu, who spoke at the weekend in Abuja during the Second Extraordinary Assembly of Health Ministers of ECOWAS, said that the region has the highest rates of epidemic-prone diseases despite the enormous efforts devoted for increased disease surveillance, preparedness and response.
The minister said that despite the outbreaks of diseases recorded in all countries of our community, mortality rates have decreased significantly.
“This fact in itself means that with better organisation and capacity building interventions, we can surely achieve positive results in the control of epidemics,” he said.
He said that WAHO has tried to make the fight easy by developing a 2011-2014 regional support plan for epidemic prone disease control in the ECOWAS region.
Also speaking, Dr. Placido Cardoso, Director General of WAHO said “our mandate requires that we support the efforts of ECOWAS member-states to reduce the burden of morbidity and mortality due to epidemic-prone diseases and their negative impact on socio-economic development in the region
“It is also our responsibility to lead a dynamic regional coordination of preparedness and response to epidemics, in collaboration with states, technical and financial partners.” he said.

Jennifer Lopez has launched a legal battle to prevent the release of sex videos taped by ex-husband showing her ''flashing''.

The singer has taken Ojai Noa and his agent Ed Meyer to court to stop their reported attempt to sell and market videos made during the couple's 11-month marriage in 1997.

In the videos, she is seen flashing her private parts and displaying other ''deviant behaviour'', according to documents filed in the singer's legal fight to keep the tapes secret.

'This is among other nudity on her part in the now 21 hours of home movies that we have so far recovered,' the Daily Mail quoted Meyer as saying in the papers.

Ojani is continually finding more and more home videos with Lopez that he didn''t remember he had, Meyer added.

Although the tapes do not contain full sex scenes they could be of great embarrassment to the star who is married to Mark Anthony and has two-year-old twins Max and Emme.

'However, Noa & Meyer have never ever intended to market this and the many other racy, damaging & expositive scenes from the Home Videos,' the court filing said.

'It must also be stated that in Noa''s Home Videos, Lopez gives her full consent to Noa taping her,' the documents added.

But Lopez is not agreeing to these tapes being made public saying they are private and personal, claiming that Noa and filmmaker Meyer are violating an injunction which blocks the release of the videos.

Israel is insulting its Ethiopian Jewish community


Yesterday's cabinet decision to "bring the last of the Falashmura to Israel" gives members of this community grounds to feel insulted. It is patronizing, even hostile. It demands that activists on behalf of the Falashmura cease their activities and sets a quota beyond which no additional Falashmura will be brought here - as if they were barrels of hazardous waste that had to be eliminated.
The decision also has a logical flaw. If there is no justification for bringing the Falashmura here, why is Israel doing it, despite the considerable social and economic costs involved? If, alternatively, they are entitled to Israeli citizenship, why set a quota? For citizens of what other country has Israel ever set an immigration quota? Indeed, this smacks of pure racism.

Benjamin Netanyahu undoubtedly felt a sense of deja vu yesterday. In June 1998, during his first term as prime minister, he announced that Israel would no longer allow in Falashmura. Now, his second government has made the same proclamation. What are the chances that this time it will actually happen?
For two decades - ever since Operation Solomon, the 1991 airlift of Ethiopian Jews to Israel - every govermnent has wrestled with the Falashmura dilemma. Numerous committees have presented contradictory recommendations, none of which were ever implemented, and estimates of the number of Falashmura remaining have all proven to be divorced from reality.
The only prophecy that did come true was that of settler leader Hanan Porat, who tried in vain to convince then-prime minister Yitzhak Shamir to let 2,500 Falashmura board the 1991 airlift. "They didn't let 2,000 immigrate today," he said. "In the end, 20,000 will come."
An odd mix of rabbis, settlers, Shas politicians, Jewish-American donors and a handful of self-interested Ethiopian immigrant activists, who certainly do not represent the majority of their community, have for years succeeded again and again in forcing prime ministers to eat their words and bring thousands upon thousands of Ethiopian Christians to Israel.
A few senior civil servants tried to stem the tide. One such example is Eyal Gabbai, director general of the Prime Minister's Office, who ultimately broke under the pressure but did manage to get a written commitment from all parties concerned that once the 7,864 Falashmura covered in today's decision have arrived, the Falashmura lobby will disband.
But even if these organizations and individuals keep their promise, there will still be thousands of Ethiopians who claim to have Jewish roots and relatives already living in Israel. And they will continue to be aided by settlers who believe that bringing the "lost tribes" back to Israel can solve the demographic problem, Shas politicians who want to prove they don't hate blacks, and American Jews who want to "repair the world" at Israeli society's expense.
The current organizations might disband, but new ones will emerge in their place. Thousands of new Falashmura will flock to the compound in Gondar. Ethiopian Israelis will hold demonstration to bring their parents and siblings be here. And yet another government will capitulate.

CBN bars banks from giving loans to politicians

THE Central Bank of Nigeria (CBN) has barred commercial banks from offering loans and gifts to political parties, under new industry rules.
According to the apex bank, banks have been prohibited from purchasing any real estate other than for their offices and branches. The rules come into effect  today.
The CBN is tightening laws after firing the chief executive officers of eight of the country’s 24 banks last year after bad debts, much of them from loans to speculators in the local stock market, threatened the industry. The CBN pumped N620 billion into banks and set up the state-owned Asset Management Corporation of Nigeria (AMCON) that will buy N2.2 trillion of bad debts from them this year.
“Banks must operate as commercial, merchant and specialised lenders, with universal banking falling away, the Central Bank said on Sunday. They have 90 days to submit a compliance plan,” it said.
Under the rules, banks won’t be allowed to give loans for people to invest in the primary issues of shares of banks,” the Central Bank said.
It will be recalled that the former Chief Executive Officer of Oceanic Bank Plc, one of those bailed out during the debt crisis, Mrs Cecilia Ibru, was convicted by a high court last month for bank fraud. She forfeited N191 billion in assets and funds, including 94 properties in the U.S., Dubai and Nigeria and shares in 100 companies, according to the Central Bank.

Resolve reiterated in war against diabetes in Bangalore

The city saw several events on the occasion of World Diabetes Day, which also coincided with Children’s Day. Manipal Hospital organised a programme, diaBEATes IT, in which over 30 children suffering from Type 1 diabetes participated.
Enthusiastic children in the age group of 4-14 participated in various events that started as early as 7 am, setting the example of leading a joyous life despite health problems. The event was inaugurated by artist Raghu Dixit.
“One of the reasons why we are holding this event was to show that even children with diabetes can lead a normal life like others,” said Dr Shaila S Bhattacharya, consultant paediatrician and endocrinologist, Manipal Hospital.
She said that these children need to take more care of themselves than others.
“Children with Type 1 diabetes need to take insulin on a daily basis and follow a strict diet. But, today unlike their routine life they are having fun,” said Bhattacharya.
To mark the day, the Rotary Club organised a walkathon flagged off by mayor SK Nataraj. Siddaiah, commissioner of Bruhat Bangalore Mahanagara Palike, was also present on the occasion. Participants walked holding banners with message of diabetes control. Information booklets on the disease were also distributed during the event.
Dr Shuchy Chugh, diabetes educator and a type 1 diabetic, said that diabetes was a serious concern in India. Changing lifestyle, increasing stress levels, a genetic pre-disposition and most seriously, neglect of timely screening and treatment have resulted in a pandemic in India.
VAGUS Super Speciality Hospital held a free diabetic screening camp at the hospital’s premises in Malleswaram. The camp was inaugurated by transport commissioner Bhaskar Rao. More than 200 people availed of the camp.
“Early screening and therapeutic interventions are very important. Once diabetes is diagnosed, lifestyle changes/interventions and drugs are most important to prevent or reduce the onset of diabetes,” said diabetalogist Dr Somshekar Reddy.

Nigerian security rejects reports that arms were bound for Gaza

Security forces in Nigeria believe a recently-seized arms shipment -- reportedly from Iran -- was bound for the western African nation, not another land.
Marilyn Ogar, spokeswoman for the county's security service, on Friday rejected reports that the material was headed to the Palestinian territory of Gaza, as claimed by some reports in Israel.
In fact, some observers speculate, the weaponry was seized ahead of the 2011 controversial elections which would pit Goodluck Jonathan, the current president from the Christian south, and presidential candidates from the Muslim north.
The country's security service said that it had seized 13 shipping containers in the port of Lagos filled with illegal weapons, including rockets, grenades and bullets.
Each shipping container carried 20 wooden crates, and a leading global shipping company has said that the weaponry came from Iran.
Nigerian officials won't confirm that the materiel originated in Iran, and the country's foreign ministry issued a statement knocking down reports that Nigeria was targeting a particular nation in its investigations and that it was planning to go to the United Nations to lodge a complaint.
This comes as the foreign ministers of Nigeria and Iran met on Thursday.
"If at the end of these investigations, there were breaches of international instruments or conventions to which Nigeria is party, the country would, as a responsible member of the international community, 'do whatever was necessary,' " the Foreign Ministry said in a statement.
The company, CMA CGM, said it was a victim of a false cargo declaration. The shipper -- who the company identified as an Iranian trader -- had listed the materials inside the containers as "packages of glass wool and pallets of stone."
The containers in question were loaded in Bandar Abbas, a port in southern Iran, and discharged in Lagos in July, the company said.
There has been Christian-Muslim sectarian violence in northern Nigeria, and analysts say the upcoming vote will potentially be one of the most controversial and violent election periods in the country's history.

Gunmen Bomb Timi Alaibe’s House •Kill One Policeman

An explosive suspected to be bomb at the early hour of Friday went off  at the premises of the Special Adviser to the President on Niger Delta Matter, Mr. Ndutimi Alaibe, in Opokuma community, Kolokuma/ Opokuma Local Government Area of Bayelsa State, killing one police constable.
The attack, allegedly carried out by  suspected gunmen, was confirmed by the Commissioner of Police in the state, Mr. Aliyu Musa, stating that one of his men died while the other one earlier declared missing had been found.
Aliyu said the gunmen did not go away with any of the property in the house. He, however,  stated that one of the hoodlums alleged to have participated in the bombing of the building had been arrested.
This is coming barely 48 hours after the police foiled the attempt to bomb the popular Ekeki Motor park by suspected members of the Movement for the Emancipation of the Niger Delta (MEND) which has thrown the entire community into panic.
Unconfirmed reports disclosed that the suspected gunmen invaded the  community around 1:00 a.m and started shooting sporadically into the air to scare villagers..
After gaining entry into the compound, the bomb was  allegedly detonated, thereby causing severe damage to the building.
However, it could not be ascertained whether the victim was shot while trying to repel the attack by the gunmen.
As of the time of filing this report, movements to the compound have been restricted while passersby were subjected to search by combined team of police and operatives of the Joint Military Task Force, (JTF).
Also, anti-bomb squad was said to have been deployed in the area in order to ascertain whether there are explosives that are yet to be detonated.
Meanwhile, the Action Congress of Nigeria (ACN) has called for a full investigation into Friday’s bombing  describing the act as barbaric, inhuman and cowardly.
Making this known in a statement, the state chairman of the party, Mr Miriki Ebikibina, noted with dismay that the attack was coming barely few weeks after a similar one was launched at the oil installation of the Nigeria Agip Oil Company, (NAOC).
Meanwhile, Special assistant to Alaibe, Henry Ngbolue, described the bomb blast as shocking, saying details of the incident were not known yet.
According to him, his boss was in Abuja when the event took place, adding that Alaibe remained unruffled.

Iraq gets new government after coalition deal Iraq will finally get a new government on Thursday after politicians hammered out a late-night deal to end eight months of wrangling following an indecisive election.

The country's 249 days of impasse set a new world record, and led to fears in America and among its neighbours that it could descend into civil war.
The nationalist Iraqiya party, headed by the pro-western secular former prime minister, Ayad Allawi, agreed under heavy pressure to back a national unity coalition.
That coalition will be led by the current prime minister, Nouri al-Maliki, whom Mr Allawi detests. Iraqiya won two more seats that Mr Maliki's mainly Shia State of Law party in the March elections, and until this week Mr Allawi had been refusing to play second fiddle to his great rival.

Jalal Talabani, the Kurdish leader who holds a balance of power between the religious Shia, secular Shia and Sunni groups that make up Iraq's fractured politics, will remain president, a largely ceremonial post.
Iraqiya will be offered the position of speaker, a compromise it previously rejected, and will also provide the foreign minister. There will also be a new inner council of ministers to oversee defence and security issues – a suggestion from Washington, which was keen to see Mr Allawi join a government.
Mr Allawi is Shia, but factions within his party are the main voice of Iraq's Sunni minority. Its participation in government was seen as vital to prevent disaffected Sunnis joining al-Qaeda or other insurgent groups.
Mr Allawi's bid for power was also opposed by Iran, who negotiated an alliance between State of Law and other more radical Shia groups to boost Mr Maliki's hopes of staying in office. An Iraqiya presence in government will also be welcomed by Washington and Iraq's Arab neighbours as a brake on Iran's growing regional influence.
"The apparent agreement to form an inclusive government is a big step forward for Iraq," said Tony Blinken, who is national security adviser to Joe Biden, the vice-president who has overseen Iraq policy.
"All along we've said the best result would be a government that reflects the results of the elections, includes all the major blocs representing Iraq's ethnic and sectarian groups, and that does not exclude or marginalise anyone."
The agreement means that the most fiercely anti-American political party in Iraq, the Sadrist movement, which joined the Shia alliance, is also likely to join the government. American officials previously told The Telegraph that this was acceptable so long as they did not win control of any security-related ministry.
The Sadrists' Mahdi Army fought a bitter war with both American and government forces following the 2003 invasion, and were only finally defeated in 2008.
Mr Allawi will still be accused by some Sunnis of caving in to Mr Maliki and allowing Iran a greater influence in Iraqi politics. "The pressure of Iran was too much," said Saleh al-Mutlaq, a Sunni Iraqiya leader.
However, the immediate issue will be whether such a diverse government can work together to improve security sufficiently to prevent a continued flight of the educated classes and for economic growth to resume.
Mr Maliki is accused of using the all-powerful prime minister's office to exert an often brutal control over the levers of government and the security forces. The outcome of negotiations show that his position was scarcely weakened by the Wikileaks revelations last month of extensive use of torture and even murder in Iraqi jails.
Parliament will meet later on Thursday for only the second time since the election to ratify the deal.
"Tomorrow in parliament, it will be the beginning of forming not just the government, but forming the Iraqi state," Mr Maliki said on Wednesday night. "God willing, we will go ahead."

Cameron criticises police for not protecting Tory HQ against students

David Cameron has criticised the police for failing to protect Conservative headquarters and for underestimating the strength of a student protest that turned into a riot.
Mr Cameron said he agreed that police had lessons to learn on how they handled the protest.
“I thought it was extremely serious. I could see a line –a thin blue line- of extremely brave police officers trying to hold back a bunch of people who were intent on violence and destruction.
"As the police themselves have said, there weren't enough of them and the police response needs to reflect that," he said.
"So I'm very glad that the Metropolitan Police Commissioner has said what he said and I think we need to learn the lessons very rapidly."
Peter Smyth, chairman of the Metropolitan Police Federation, rejected Sir Paul's comments, saying: "Once again, Metropolitan Police officers stand between violent protesters, innocent members of the public and property while under attack and facing extreme provocation.
"The officers have shown great restraint and professionalism. It is a reminder that the Government must maintain the number of fully warranted police officers to ensure that policing these spontaneous incidents, along with their every day duties, can be sustained in the capital.
"While we understand and support the right to peaceful protest, police officers must be supported when dealing with such unprovoked violence."
The demonstration, organised by the National Union of Students and the University and College Union, started peacefully, with up to 50,000 students, lecturers and supporters, marching from Whitehall past Downing Street and Parliament.
But around an hour after the protest started, violence flared at Millbank Tower, close to the Tate Britain art gallery where the march was due to end with a rally.
Hundreds of workers were evacuated from the building, which also houses other organisations including Government agencies, as windows were smashed and a fire was lit.
About 50 protesters got on to the roof, dropping a large metal fire extinguisher on to riot police. Water fire extinguishers were also let off from the roof and eggs were thrown.
Police officers formed a line across Millbank after clearing the forecourt area of the tower, which was left strewn with debris and ash.
More than 200 officers remained at the scene in full riot gear, holding back a small group of noisy protesters.
Inside the severely damaged lobby of Millbank Tower, a group of around 25 protesters could be seen surrounded by police in fluorescent jackets.
Officers led them down from various floors of the the seven-storey building where they were found after running inside at the peak of the riot.
A thick line of riot police surrounded the remaining 25 or so students detained in the lobby of Millbank Tower.
The students, who had earlier been shouting as they stood feet from officers, fell largely silent but remained cheerful.
A young woman did her make-up just a few feet away from a uniformed riot officer.
Another held up a sign reading: "We are hostages to the police. We are fine but want pizza, lower uni fees."

South Korea, U.S. fail to resolve trade deal row

SEOUL, Nov 11 (Reuters) - The United States and South Korea failed to revive a stalled free trade agreement on Thursday, dealing a blow to both countries' leaders and putting a brake on bilateral trade.
U.S. President Barack Obama and South Korea's Lee Myung-bak said negotiators would continue talks to address U.S. concerns that the deal does not do enough to open South Korean markets to U.S. beef and autos.
"We agreed that more time is needed to resolve detailed issues and asked trade ministers to reach a mutually acceptable deal as soon as possible," Lee told told a joint news conference with Obama on the sidelines of a G20 summit.
The deal, if ratified by the two countries' assemblies, would be one of the largest free trade pacts ever. It is the largest signed by the United States since the North American Free Trade Agreement that went into effect in 1994.
Studies said the deal would boost the $66.7 billion annual two-way trade by as much as a quarter.
Lee said negotiators would return to the table after the G20 meetings are over this week to try to resolve U.S. concerns, but rejected the suggestion that trade between the two allies was on a fundamentally unfair footing.
"U.S. trade (deficit) against South Korea is about $8 billion a year. Americans seems to think it is very large; it may once used to have been, but it's come down by a lot," Lee said, adding the two were on more or less an even playing field when U.S.-made parts and intellectual property rights were factored in.
Obama said he was confident that the two sides would eventually reach an agreement and was reassured of Lee's commitment.
"President Lee and I agreed that we need to make sure that over the next several weeks, we are crossing all the t's, dotting all the i's, being able to make the case to both the Korean people and the United States population that this is good for both countries.
"... We don't want months to pass before we get this done, we want this to be done in a matter of weeks."

Court of Appeal sacks Uduaghan

More than three years after he was sworn in as governor of Delta State, the Court of Appeal sitting in Benin, yesterday nullified the election of Emmanuel Uduaghan and ordered the Independent National Electoral Commission [INEC] to conduct fresh elections in the state within 90 days.
In the same vein, the court also ordered that the speaker of the Delta State House of Assembly, Sam Obi be sworn in within 24 hours as the acting governor of the state pending the conduct of fresh elections. The appeal court was presided over by Justice Mensah, who ordered the Independent National Electoral Commission (INEC) to conduct a re-run election in three months.
The annulment was the result of the appeal brought by the governorship candidate of Democratic People’s Party (DPP) in Delta State in the 2007 elections, Great Ogboru against the election of Mr Uduaghan, who has governed the state since 2007.
On October 19, 2009, the five-man Elections Tribunal sitting in Asaba had dismissed the petition filed by Mr. Ogboru challenging the election, in an unanimous decision. The tribunal held that the petitioner failed to prove that there was no election in most of the voting centres, as alleged in his petition and that he also failed to prove a case of gross rigging.
According to that judgment which was read by the chairman of the tribunal, B.S. Mohammed, Mr Ogboru’s claim was doubtful and a lot of doubt has been cast in the statements of the petitioner’s witnesses. The tribunal also ruled that the onus of proving non-voting lies on the petitioner, which the petitioner failed to prove.
“Cases are won in the court by hard facts and not by mere sentiments. The evidence adduced by the petitioner is hardly inadequate. This petition fails and hereby dismissed,” Mr Mohammed ruled.
But Mr Ogboru finally had his day at the appellate court, which ruled yesterday that the 2007 governorship election, in which Mr. Uduaghan was declared winner, was characterized by malpractices. The appeal panel had earlier dismissed the petition brought by the AC candidate, Peter Okocha, where he sought the nullification of Mr. Uduaghan’s election because of his exclusion from the 2007 election by the electoral commission.
In dismissing Mr. Okocha’s petition, “the tribunal held that the petitioners have not been able to establish that the 1st Petitioner was validly nominated to contest the April 14, 2007 gubernatorial election in Delta State.”
No cause for alarm
As news of the court judgement spread yesterday, Benin City, the Edo State capital erupted in jubilation as supporters of the DPP candidate and others hugged one another.
But the Delta State government said there was no cause for alarm and it was obeying court orders.
The leader of the Delta State Elder, Leaders and Stakeholders Forum, Richard Tosanwumi, and a former commissioner during the tenure of former governor, James Ibori, however said that the judgment is good riddance to bad rubbish.
Mr Tosanwumi said the judgment has finally collapsed the Ibori dynasty in the state.
“We must try to manage this so that the fraud which characterized the Uduaghan’s election don’t repeat itself during the re-run,” Mr Tosanwumi said yesterday on phone.
The new acting governor was himself sworn in last September following the sack of former speaker, Martin Okonta whose election was nullified by an Appeal Court in Abuja.
Great Ogboru
Mr. Ogboru had, in 2003, contested elections on the platform of Alliance for Democracy (AD) against Mr Ibori. He lost the election and the subsequent court actions against Mr. Ibori.
His political career came into prominence in 1990, during the regime of military president, Ibrahim Babangida, when he was declared wanted as an accomplice when a group of army officers led by Gideon Orka, a Major attempted a coup against Mr. Babangida.
The Babangida government alleged that Mr. Ogboru bankrolled the coup, but he fled the country to escape arrest. He was on exile until the return of civilian rule to the country in May 1999.
The government of President Olusegun Obasanjo absolved him of the coup charges.

China to buy USD 1.2 billion Rolls-Royce engines Airbus fleet

Prime Minister David Cameron, leading his country’s largest—ever official delegation to China, today met his Chinese counterpart Wen Jiabao as the two countries signed deals worth more than one billion dollars.
The prime minister, who is visiting China for the first time after taking up the top post, is heading a delegation of four cabinet ministers and 43 business leaders.

He described the two—day visit as a “vitally important trade mission“.
“We have a really high—level dialogue with China on all sorts of issues, ranging from the economic and trade and business, and yes, of course, human rights, too. And that’s as it should be,” Mr. Camaron was quoted as saying by BBC.

China today inked USD 1.2 billion deal with Britain to purchase Rolls—Royce engines for 16 Airbus A330 jets, official media here reported.
The deal was signed after Mr. Wen met Mr. Cameron at the Great Hall of the People. Rolls—Royce also agreed to provide oil consumption—minimisation systems to China Eastern.
Mr. Cameron, who is heading a delegation of over 50 British businessmen, held bilateral talks with Mr. Wen and discussed ways to further enhance the friendly cooperation between the two sides.
The British premier’s efforts to build business ties with Beijing, however, risked being eclipsed amid growing pressure on him to raise the issue of China’s human rights record.

Mr. Cameron is the first Western leader to visit China since jailed dissident Liu Xiaobo was awarded the Nobel Peace Prize on October 8 —— an honour hailed in the West but decried by Beijing as tantamount to “encouraging crime“.
The British leader said while it is “right we have a dialogue about these things,” “we shouldn’t be lecturing or hectoring“.
Mr. Cameron’s Labour—Liberal—Democrat coalition, which came to power in May, is looking for new sources of economic growth after unveiling the deepest public sector spending cuts in decades last month.
Ahead of his visit, China said it attached “great importance” to its ties with Britain and would like to “inject new vitality” to the bilateral ties.
China also looks for positive results out of the visit as it came before the G—20 summit to be held in Seoul on November 11 and 12.

U.S. move to secure release of nationals kidnapped in Niger Delta

The U.S. government says it is working with the Nigerian government to secure the release of its nationals kidnapped after Monday's armed attack in an oil rig in Niger Delta.



Philip Crowley, the State Department Spokesperson, told journalists in Washington D.C that the U.S. government was concerned about the safety of its nationals and hoped for their immediate release.
"We can confirm that of the seven individuals taken from a rig in the Niger Delta, two are U.S. citizens," he said. "We are working with Nigerian authorities to secure their prompt release and there's an investigation already underway."
Gunmen had attacked an offshore oil rig operated by exploration firm Afren, kidnapping five crew members including foreigners and injuring two others, the company said on Monday.
The attack took place on Sunday in the shallow-water Okoro oilfield off the Obolo local government area of Akwa Ibom.
The Movement for the Emancipation of the Niger Delta (MEND), on Tuesday morning, claimed responsibility for the attack.

Mr Crowley confirmed that one of those wounded was also an American, and was currently undergoing treatment.

Jonathan, Nwodo meet over state of PDP in South West


President Goodluck Jonathan is worried that the Peoples Democratic Party (PDP) is fast losing grip of the South West zone, which he believes might affect the party's outing in the 2011 general elections.
The President is said to have expressed his fears, during a meeting with the national chairman of the PDP, Okwesilieze Nwodo last weekend.
Three of the six states in the South West region are controlled by opposition parties while there are protracted crises in the others controlled by the PDP.
The six states in the zone are Oyo, Ogun, Osun Ondo, Ekiti and Lagos. While Oyo, Ogun and Osun are controlled by the PDP, Lagos and Ekiti are run by Action Congress of Nigeria (ACN) administrations. The Labour Party controls the government in Ondo State.
According to a source at the national secretariat of the PDP, Mr Okwesilieze, who returned from his overseas trip last Friday, was said to have met with the President to discuss the state of affairs in the ruling party.
Mr Jonathan was said to have mandated the PDP chairman during the meeting to explore all avenues towards resolving the crises and unite the various factions in the party in the zone.
"Jonathan gave Nwodo the mandate to explore all avenues towards resolving the crises so as to avoid a situation where the main opposition party in the South West, the Action Congress of Nigeria could exploit the crack within the PDP state chapters to its advantage," the source said.
Both Messrs Jonathan and Nwodo were said to have discussed the crisis in Enugu State, especially the dissolution of the party's executive in the state.
The President, the source said, insisted that the matter should be left to the court to determine since some members of the party had challenged the dissolution in court.
It was learnt that the President, who is the leader of the party, was aware of the plan to dissolve the executive in Enugu, having held a meeting with Mr Nwodo and some members of the National Working Committee (NWC) before he (Nwodo) went on vacation abroad.
Our source indicated that Enugu State chapter was dissolved because it was among the chapters whose members did not challenge their 2008 congresses in court but merely quarrelled over the matter.
When contacted yesterday, Ike Abonyi, the media aide to Mr Nwodo said he was not aware that Mr Jonathan is worried over the state of PDP in the south west zone.
"I am not aware of the President's position on the matter you are talking about. All I can say is that the PDP chairman returned from abroad last Friday. I have not been briefed about his meeting with the President," Mr Abonyi said.
